The Jharkhand High Court has directed the Anti-Corruption Bureau (ACB) to register an FIR against officials and employees of Namkum circle allegedly involved in irregularities in land transactions and the disappearance of original revenue records.
The bench of Justice Rajesh Shankar, while hearing the matter, also directed the ACB to submit a sealed report on August 28 regarding the FIR registered against the officials and employees found prima facie responsible for the alleged irregularities.
During the hearing, ACB senior standing counsel Sumit Gadodia informed the court that the bureau had initiated a preliminary enquiry (PE) after obtaining permission from the Cabinet Secretary on a complaint concerning irregularities in land transactions in Namkum circle and the disappearance of revenue records.
The investigation subsequently brought to light the prima facie involvement of officials and employees of the Namkum circle office. Taking note of the ACB’s findings, the court directed the bureau to register an FIR against those found responsible.
The case stems from alleged irregularities in the mutation of land and the disappearance of original revenue records. Petitioner Thomas Simon approached the High Court alleging serious discrepancies in a mutation proceeding at the Namkum circle office.
Despite the original revenue records being sought for the purpose of investigation, the records were allegedly not made available. The disputed land is located in the Dundu area under Namkum circle.
During an earlier hearing, the court had also been informed that the circle office was reluctant to provide a certified copy of the mutation order made in favour of the opposite party.
The alleged non-compliance continued despite a specific direction from the High Court.
Taking a serious view of the prima facie irregularities emerging from government records, the court had entrusted the matter to the ACB for investigation.
